Former Pottawatomie County deputy charged with falsely reporting a crime
A former deputy with the Pottawatomie County Sheriff’s Office has been charged after making up a vehicle pursuit and claiming he was shot at before opening fire.

UP. KOCO’S JASON BURGER HAS MORE. WELL, GUYS, ACCORDING TO THESE NEW COURT DOCUMENTS, THE DEPUTY MADE IT ALL UP. THE SHOOTING, THE PURSUIT, EVEN THE DESCRIPTION OF THE SUSPECT WAS MADE UP AND ALMOST THREE YEARS AFTER THE INCIDENT, THIS DEPUTY IS NOW CHARGED. CENTER ON LOOSE INSIDE OF THIS VEHICLE AND COMING UP ON OAK ROAD, POTTAWATOMIE COUNTY SHERIFF’S OFFICE GAVE US DEPUTY TAYLOR SMITH’S BODY CAMERA VIDEO FROM SEPTEMBER 1ST OF 2021. AT THIS POINT, HE’S ALREADY TOLD DISPATCH HE’S IN A PURSUIT ON OAK ROAD. THEY’VE GOT TO BE DOING 115, 120. THEY’RE PULLING AWAY FROM ME REAL FAR. THE DEPUTY THEN GETS OUT ON FOOT, DESCRIBING WHAT HE SAYS IS AN ARMED SUSPECT THAT JUST GOT OUT OF A RED SEDAN NEAR OAK ROAD AND HOPE ROAD. DEPUTY SMITH CLAIMS HE TOOK OFF ACROSS A NEARBY FIELD. HE HAS A RIFLE, LARGE BACKPACK. HERE’S THE FRONT SEAT PASSENGER RED SHIRT, BLACK MALE, THEN THE DEPUTY STARTS FIRING AFTER HE THINKS THE SUSPECT TAKES A SHOT AT HIM WITH A LONG GUN. SHOT FIRED. SHOTS FIRE. BUT ACCORDING TO NEW COURT DOCUMENTS, RECENTLY FILED NOTHING. THE DEPUTY CLAIMED TO SEE ACTUALLY HAPPENED. SHERIFF BOOTH CALLED IN OSBI THAT SAME DAY AND ACCORDING TO THE DOCUMENTS, QUOTE, UPON REVIEW OF SMITH’S BODY WORN CAMERA FOOTAGE, NEITHER THE RED SEDAN NOR THE SUSPECT WITH THE LONG GUN WAS OBSERVED. OUR CAMERAS WERE ROLLING AT THE SCENE THAT DAY. SHERIFF’S DEPUTIES, POLICE OFFICERS AND OHP TROOPERS ALL RESPONDED, BUT AFTER THE OSBI INVESTIGATION CONCLUDED, THE COURT DOCUMENTS SAY, QUOTE, SMITH’S PATROL VEHICLE WAS RECORDED BY TWO RESIDENTIAL SECURITY CAMERAS ALONG THE ROUTE OF THE PURSUIT. BUT THE FOOTAGE REFLECTED NO RED SEDAN TRAVELING IN FRONT OF SMITH’S VEHICLE WITHIN THE TIME FRAME. I HOLLERED AT HIM. HE TOOK WHAT WAS IN HIS HANDS AND HE PULLED IT UP AND MOVED IT. AND I SAW HIS SHOULDERS MOVE LIKE THIS. NO OTHER LAW ENFORCEMENT PERSONNEL REPORTED SEEING A SUSPECT VEHICLE OR ANY ARMED SUSPECT DURING THE WHOLE INCIDENT. THE DOCUMENTS SAY OFFICIALS AT THE SCENE FOUND SHELL CASINGS FROM DEPUTY SMITH’S PISTOL, BUT FOUND NO EVIDENCE TO SUPPORT THE PRESENCE OF ANY SUSPECT AT THAT LOCATION. From body camera footage released by the sheriff’s office, Smith told dispatchers he was in pursuit, then could be seen on foot, describing an armed suspect getting out of a red sedan and that he had a “rifle.”
Smith could then be seen firing a pistol after he thought he had been shot at.
