'Never did the safety checks': Jury member speaks following 'Rust' armorer guilty verdict
Updated: 9:56 AM CST Mar 7, 2024
INVOLUNTARY MANSLAUGHTER VERDICT. BUT AT SOME POINT THE JURY DID HAVE A QUESTION A CLARIFICATION QUESTION TO ASK THE PROSECUTION. THEY WENT BACK INSIDE, MADE THEIR DECISION AND CAME OUT. NOW THE FEELING IN THE COURTROOM WAS PRETTY QUIET AS THE VERDICT WAS READ. WE COULD SEE HANNAH GUTIERREZ-REED REALLY PUTTING HER HEAD DOWN, REALLY TAKING THAT MOMENT IN. NOW, JUDGE MARLOW SOMMER DID ASK FOR HER TO BE TAKEN INTO CUSTODY. RIGHT IN THAT MOMENT. AND IN THAT MOMENT, A WOMAN IN THE JURY IN THE ROOM, THE COURTROOM AT THAT TIME ALSO HAD A VERY STRONG REACTION. WE DON’T KNOW HOW SHE’S RELATED TO HANNAH GUTIERREZ-REED, BUT THEY DID EXCHANGE A FEW WORDS BEFORE SHE WAS TAKEN INTO CUSTODY. AND RIGHT NOW, AS WE ARE OUTSIDE OF THE COURTROOM, WE DID SEE SOME OF THOSE JURORS WALK OUT, AND I WAS ABLE TO TALK TO ONE OF THEM WHO REALLY SAID THIS WAS A VERY EASY DECISION. IT WAS A LOT OF THE SAFETY ISSUES THAT SHE COULD HAVE PAUSED WORK, STOPPED, CLEARED IT ALL UP, AND JUST NEVER DID. PRETTY MUCH. IT WAS JUST THAT ALL THE NEVER DID THE SAFETY CHECKS, NEVER CHECKED THE ROUNDS TO PULL THEM OUT, TO LOOK AT THEM, SHAKE THEM. I MEAN, IF YOU’D HAVE DONE THAT, THIS WOULDN’T HAVE HAPPENED. SAME JUROR DID ANSWER A FEW OTHER QUESTIONS. AND ONE OF THE THINGS THAT I REALLY WANTED TO ASK HIM WAS IF HE BELIEVED THAT AT ANY POINT HANNAH GUTIERREZ-REED WAS SABOTAGED, AND HE ANSWERED NO TO THAT. BUT RIGHT NOW WE DO HAVE OUR KOAT LEGAL EXPERT, JOHN ROYALE DA. WE’VE BEEN FOLLOWING THIS CASE PRETTY MUCH SINCE THE BEGINNING. WHAT IS SOMETHING THAT YOU THINK STOOD OUT AS WE WERE GOING THROUGH THESE TEN DAYS OF TRIAL? AND FINALLY, THIS VERDICT? WELL, IT’S CLEAR THAT THE JURORS TOOK VERY SERIOUSLY THE IDEA THAT HANNAH GUTIERREZ-REED HAD A JOB, AND THAT WAS TO MAKE SURE THAT THE GUNS AND THE AMMO AND EVERYBODY ELSE ON THE SET WERE SAFE. THINGS WERE TREATED WITH CARE AND CAUTION, AND THE JURORS, IT WAS CLEAR THEY DIDN’T THINK THAT SHE DID THAT. SO THAT WAS A VERY QUICK VERDICT. YOU KNOW, THEY WENT IN THERE, THEY HAD TO PICK A FOREMAN THAT PROBABLY TOOK 5 OR 10 MINUTES. AND SO THE REST OF THAT TIME WAS SPENT LOOKING AT THE JURY INSTRUCTIONS. BUT I THINK GOING INTO THE DELIBERATION. THE JURORS KNEW WHAT THEY WANTED TO DO. ONE OF THE THINGS THAT I THINK SHOCKED EVERYONE IN THE COURTROOM ROOM WAS THE MOMENT THAT THE PROSECUTION ASKED FOR HANNAH GUTIERREZ-REED TO BE TAKEN INTO CUSTODY AND JUDGE MARLOW SUMMER, SHE GRANTED THAT PRETTY INSTANTLY. TELL US A LITTLE BIT MORE ABOUT THE SIGNIFICANCE OF THAT. WELL, THE JUDGE COULD HAVE SAID, I’M GOING TO LET YOU OUT. YOU’VE BEEN ON CONDITIONS OF RELEASE THIS WHOLE TIME, AND YOU’VE ABIDED BY THE CONDITIONS. THERE HAVE BEEN NO VIOLATIONS. THE JUDGE COULD HAVE SAID, I’M GOING TO LET YOU OUT UNTIL THE SENTENCING SEASON. BUT SHE DIDN’T DO THAT. SHE SAID SOMEONE DIED HERE. YOU’RE GUILTY OF INVOLUNTARY MANSLAUGHTER. YOU’RE GOING TO BE REMANDED INTO CUSTODY. SO HANNAH GUTIERREZ-REED IS GOING TO BE SPENDING TONIGHT AND PROBABLY MANY MORE NIGHTS UNTIL SENTENCING AT THE SANTA FE ADULT DETENTION CENTER. RIGHT NOW, FROM EVERYTHING THAT WE’VE SEEN SO FAR ON THIS TRIAL, WE’VE SEEN HUNDREDS OF PIECES OF EVIDENCE, VIDEOS, PHOTOS, AMMUNITION, VIDEOS OF ALEC BALDWIN, WHAT KIND OF PRECEDENT OR MESSAGE DO YOU THINK THIS SENDS? AS WE GET A LITTLE BIT CLOSER TO ALEC BALDWIN’S TRIAL FOR FOR THE SAME RUST SHOOTING? WELL, IT’S GOING TO BE AN INTERESTING NIGHT FOR ALEC BALDWIN AND HIS DEFENSE TEAM TONIGHT. I MEAN, BECAUSE THEY’VE BEEN ABLE TO WATCH THE PROSECUTION LAY OUT THEIR CASE SO THEY GET SOME INSIGHT INTO THE PROSECUTION’S PLAYBOOK. SO WHEN THEIR TRIAL STARTS IN JULY OR WHENEVER IT DOES START, THEY’RE GOING TO KNOW HOW THE PROSECUTION PRESENTS ITS CASE, HOW THEY ARE IN COURT. ON THE OTHER HAND, THE PROSECUTORS HAVE HAD A CHANCE TO POLISH THEIR CASE. THEY KNOW HOW TO PRESENT THEIR CASE. THEY KNOW THAT THEY WERE EFFECTIVE. THEY KNOW THAT THE JURORS LIKED WHAT THEY SAW. AND SO WHEN THEY GO IN FOR THE BALDWIN TRIAL, IT’S GOING TO BE A DIFFERENT JURY, OF COURSE. BUT THE BALDWIN TRIAL, THEY’VE GOT ONE CONVICTION UNDER THEIR BELT. AND SO BALDWIN’S TEAM IS GOING TO BE WATCHING VERY CAREFULLY AND GOING THROUGH EVERY SINGLE BIT OF EVIDENCE, EVERY SINGLE WITNESS, ALL THE TESTIMONY TO SEE HOW THEY’RE GOING TO PUT THEIR CASE TOGETHER IN JULY OR WHENEVER IT IS. UH, THE ALEC BALDWIN CASE WILL ALSO BE HEARD IN FRONT OF THE SAME JUDGE. NOW THAT THIS JUDGE HAS HEARD ALL OF THIS EVIDENCE, SHE’S HEARD FROM THE STATE AND THE DEFENSE, OBVIOUSLY, ALEC BALDWIN WILL HAVE A DIFFERENT DEFENSE TEAM. BUT REALLY, WHAT ARE SOME OF THE THINGS THAT YOU THINK WE CAN EXPECT AS WE GET A LITTLE BIT CLOSER TO THAT TRIAL? WELL, YOU KNOW, THIS JUDGE I THINK THIS CASE, SHE TRIED THIS CASE, A VERY CLEAN CASE. SHE WAS VERY DIRECT. SHE’S KNOWN FOR THAT, OF COURSE, IN THIS AREA. BUT, YOU KNOW, BALDWIN’S TEAM GOT TO SEE THE PLAYBOOK. BALDWIN’S TEAM GOT TO SEE WHAT THE PROSECUTORS ARE LIKE. AND SO BALDWIN NOW KNOWS WHAT HE’S UP AGAINST. AND OF COURSE, HE KNOWS IF THERE IS A CONVICTION. IS THERE A CHANCE THAT HE WOULD ALSO BE REMANDED TO JAIL? THAT’S CERTAINLY A POSSIBILITY. THANK YOU SO MUCH, JOHN. WELL, THAT’S THE VERDICT THAT WE HEARD GUILTY OF INVOLUNTARY MANSLAUGHTER. WE ARE WAITING TO HEAR, YOU KNOW, WHAT’S NEXT? BUT HANNAH GUTIERREZ-REED WAS TAKEN INTO CUSTODY TODAY. BUT WE ARE STILL WAITING FOR A SENTENCING DATE TO KNOW EXACTLY HOW MUCH TIME SHE WILL SPEND IN JAIL. WE DID HEAR FROM HER DEFENSE ATTORNEY, JASON BOWLES, WHO SAID THEY WILL BE APPEALING THIS DECISION

SANTA FE, N.M. — A jury on Thursday found "Rust" armorer Hannah Gutierrez-Reed guilty of involuntary manslaughter for the 2021 movie set shooting death of cinematographer Halyna Hutchins. She was found not guilty of tampering with evidence.
Hear from a juror in the video above.
One member of the Santa Fe, New Mexico, jury said that they reached their verdict in part because Gutierrez-Reed did not complete safety checks.
"(She) never did the safety checks. Never checked the rounds — not looking at them or shaking them. I mean, if you did that, it wouldn't have happened," jury member Alberto Sanchez said.
Sanchez compared Gutierrez-Reed's lack of checking ammunition to his job, saying that he must use caution in his position as a CDL driver.
"I have to check my vehicle to make sure I'm not going to slam into people or something like that,” Sanchez said. “That was her job to check those rounds, those firearms."
Gutierrez-Reed's attorney Jason Bowles said he does not agree with the jury's decision.
"My sense was the evidence was not sufficient, there was a lot of guesswork," Bowles said. "A lot of speculation. But again, the jury made this verdict, and we will be appealing that."
Gutierrez-Reed faces up to 18 months in prison. She is expected to be sentenced in April.
