An Oklahoma judge is under fire for her actions in the courtroom.
Now, a chief justice of the state Supreme Court weighed in, recommending her removal from the bench. An investigation found that District Judge Traci Soderstrom exchanged more than 500 inappropriate texts with her bailiff during a murder trial.
A recommendation from the chief justice for a lower court judge to step down is rare. It has only happened eight times in the state's history.
The case against the judge is laid out in nearly 50 pages of court documents. Lincoln County District Judge Traci Soderstron had only been on the bench since January but she may soon be out of a job.
An investigation by the Oklahoma Supreme Court found Soderstrom exchanged more than 500 texts with her courtroom bailiff during a murder trial involving a 2-year-old. The texts included in a court filing showed she mocked prosecutors, praised the defense attorney and called the key prosecution witness a liar, and even laughed at a comment made by the bailiff about a prosecutor's genitals.
In one exchange about the prosecutor, Soderstrom asked, "Why does he have baby hands?... They are so weird looking."
In another message, she said the DA was "sweating through his coat."
The filing also said Soderstrom and the bailiff "discussed by text which just instructions would best fit their desired outcome."
"The most important thing a judge can do in a trial is to be fair," said Ed Blau, a lawyer.
Blau, who was not involved with the case, said for a judge to be reprimanded like this is rare.
"Litigants, defendants, and members of the public complain about judges all the time. But for their complaints to rise to the level of the chief justice of the Oklahoma Supreme Court filing charges against the judge to have him or her removed from the bench is extraordinarily unusual," Blau said.
It also alleged Soderstrom had previously criticized other attorneys and berated a member of courthouse staff. The chief justice said Soderstrom should be removed from the bench for several reasons, including, gross neglect of duty, gross partiality in office, oppression in office, and other grounds specified by the legislature.
A filing showed Soderstrom had agreed to a voluntary temporary suspension. Blau said he expects a trial to decide her fate as a judge to take place in the next three to four months.
