EVAN JESS, THAT’S RIGHT. FOR THE SUPREME COURT TO WEIGH IN AND RECOMMEND THAT A LOWER COURT JUDGE STEP DOWN IS SO RARE, IT’S ONLY HAPPENED EIGHT TIMES IN THE STATE’S HISTORY. AND THE CASE AGAINST THIS JUDGE IS ALL LAID OUT HERE IN THESE 50 SOME PAGES OF COURT DOCUMENTS. LINCOLN COUNTY DISTRICT JUDGE TRACY SÖDERSTRÖM HAS ONLY BEEN ON THE BENCH SINCE JANUARY, BUT SHE MAY SOON BE OUT OF A JOB. AN INVESTIGATION BY THE OKLAHOMA SUPREME COURT FOUND SÖDER’S STROUD EXCHANGED MORE THAN 500 TEXTS WITH HER COURTROOM BAILIFF DURING A MURDER TRIAL INVOLVING A TWO YEAR OLD. THE TEXT INCLUDED IN A COURT FILING SHOWED THAT SHE MOCKED PROSECUTORS, PRAISED THE DEFENSE ATTORNEY AND CALLED THE KEY PROSECUTION WITNESS A LIAR AND EVEN LAUGHED AT A COMMENT MADE BY THE BAILIFF ABOUT A PROSECUTOR’S GENITALS. IN ONE EXCHANGE ABOUT THE PROSECUTOR, SÖDERSTRÖM ASKED, QUOTE, WHY DOES HE HAVE BABY HANDS? THEY’RE SO WEIRD LOOKING. AND ANOTHER EXCHANGE, SHE SAID THE DA WAS, QUOTE, SWEATING THROUGH HIS COAT. THE FILING ALSO SAYS THE JUDGE AND THE BAILIFF DISCUSSED BY TEXT, WHICH JURY INSTRUCTIONS WOULD BEST FIT THEIR DESIRED OUTCOME. THE MOST IMPORTANT THING A JUDGE CAN DO IN A TRIAL IS, TO BE FAIR, ATTORNEY BLOUGH, WHO WAS NOT INVOLVED WITH THE CASE, SAYS FOR A JUDGE TO BE REPRIMANDED LIKE THIS IS RARE. LITIGANTS, DEFENDANTS AND MEMBERS OF THE PUBLIC COMPLAIN ABOUT JUDGES ALL THE TIME, BUT FOR FOR THEIR COMPLAINTS TO RISE TO THE LEVEL OF THE CHIEF JUSTICE OF THE OKLAHOMA SUPREME COURT FILING CHARGES AGAINST THE JUDGE TO HAVE HIM OR HER REMOVED FROM THE BENCH IS EXTRAORDINARILY UNUSUAL. IT IS ALSO ALLEGED THAT SÖDERSTRÖM HAD PREVIOUSLY CRITICIZED OTHER ATTORNEYS AND BERATED A MEMBER OF COURTHOUSE STAFF. THE CHIEF JUSTICE SAYS SÖDERSTRÖM SHOULD BE REMOVED FROM THE BENCH FOR SEVERAL REASONS, INCLUDING GROSS NEGLECT OF DUTY, GROSS PARTIALITY IN OFFICE AND OPPRESSION IN OFFICE AS NOW. RIGHT HERE, I HAVE A COPY OF A VOLUNTARY TEMPORARY SUSPENSION PURSUANT RULE SAYING THAT THE JUDGE HAS AGREED TO VOLUNTARILY STEP DOWN FROM THE BENCH. The case against the judge is laid out in nearly 50 pages of court documents. Lincoln County District Judge Traci Soderstron had only been on the bench since January but she may soon be out of a job.

An investigation by the Oklahoma Supreme Court found Soderstrom exchanged more than 500 texts with her courtroom bailiff during a murder trial involving a 2-year-old. The texts included in a court filing showed she mocked prosecutors, praised the defense attorney and called the key prosecution witness a liar, and even laughed at a comment made by the bailiff about a prosecutor's genitals.

In one exchange about the prosecutor, Soderstrom asked, "Why does he have baby hands?... They are so weird looking."

In another message, she said the DA was "sweating through his coat."

The filing also said Soderstrom and the bailiff "discussed by text which just instructions would best fit their desired outcome."

"The most important thing a judge can do in a trial is to be fair," said Ed Blau, a lawyer.

Blau, who was not involved with the case, said for a judge to be reprimanded like this is rare.
